What if the insurance company won't settle within the statue of limitations?

I was in an auto accident almost two years ago where the other driver hit me and was clearly at fault. I was injured and was waiting to see how things were going before I filed a claim with their insurance company. My statute of limitations runs out July 3, 2008. In April I notified them that I was ready to settle and sent medical records to them but they have said they can%26#039;t find them. They seem to be stalling and I need to know what to do to protect myself from losing this opportunity when the statute of limitations runs out. I have most recently also resent the medical records to their PO box via certified mail.

You need to file suit before that statute of limitations tolls. I would follow up with the adjuster, and ask for an offer by the end of the week. Assuming you provided them with all of the necessary documentation, it does not take that long to evaluate a claim.

You are supposed to report the accident to the Insurance Company within 30 days of becoming aware of it. In your case, and if you%26#039;ve been hospitalised for more than 30 days, they should be sympathetic to the situation and consider your claim. You can a submit all your claim documents to the Insurance Ombudsman in your City detailing the incident with dates and correspondence sent to your Insurers. The Ombudsman has the final say. Failing that, you can proceed directly against the third party which will involve going to court. Wish you luck.
Reply:You should have already filed with your insurance if you had collision which usually includes uninsured motorist insurance. Evidently you only have liability otherwise your insurance company would have already done this. Get to an attorney and get the thing filed NOW. If you wait too long, you won%26#039;t have a chance of collecting a dime.

Secondly, in order to protect the statute you would need to file suit before the date is up.





Thirdly, Maybe you can fax the information to the insurance company, or if their office is local, you can drop it off. They will still need time to review and evaluate your claim after they receive all of your medical bills.





Next time, don%26#039;t wait so long to file the claim.
